1. Acceptance of Terms
By accessing and using this website and registering to participate in a That's My Pan! fundraiser, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use this website or participate in our fundraising program. That's My Pan! (Adept Engraving LLC) reserves the right to modify these terms at any time. Your continued use of the website constitutes acceptance of any changes.
2. Fundraiser Participant Eligibility
To participate in a That's My Pan! fundraiser, you must:
- Be at least 18 years of age, or be acting as a representative of an organization
- Provide accurate and complete registration information
- Comply with all federal, state, and local fundraising regulations applicable in your jurisdiction
- Ensure that your organization is registered (if applicable) and has the legal right to conduct fundraising activities
You acknowledge that you are solely responsible for verifying that fundraising with personalized products complies with your organization's bylaws, policies, and all applicable laws.
3. Your Responsibilities as a Fundraiser
As a fundraiser participant, you agree to:
- Accurate information — provide truthful information during registration and order placement
- Order management — accurately track and communicate with donors regarding their orders and personalization preferences
- Compliance — comply with all local, state, and federal fundraising laws and regulations
- Timely payment — pay for all submitted orders within the specified timeframe (typically upon invoice)
- Resale prohibition — not engage in unauthorized resale, distribution, or commercial use of products outside your approved fundraiser
- Confidentiality — maintain the confidentiality of any customer and donor information you collect
4. Product Orders & Minimum Purchase
Minimum order size. Fundraiser participants agree to submit bulk orders of a minimum of 10 items to receive wholesale pricing and discounted shipping of $4.75 per item. Orders fewer than 10 items are subject to retail pricing and short-order shipping fees.
Order processing. Orders are processed and manufactured within 1–2 business weeks from the date That's My Pan! receives your bulk order. Turnaround may vary with personalization complexity or order volume.
Direct ship. That's My Pan! offers the option to ship orders directly to individual donors at their own addresses, outside of your group's bulk shipment, on the same timeline and shipping costs.
5. Pricing & Payment Terms
Wholesale pricing. Prices shown reflect That's My Pan!'s fundraiser wholesale costs and are guaranteed only for orders submitted through your assigned fundraiser platform.
Shipping. Prices do not include shipping. Bulk orders incur a charge of $4.75 per item. Fundraisers are responsible for collecting sufficient funds from donors to cover both product cost and shipping.
Volume rebates. That's My Pan! offers cumulative volume rebates based on total items sold across your fundraiser and any direct-ship orders:
- 50 items sold — $25 rebate
- 100 items sold — $50 total rebate ($25 additional)
- 200 items sold — $100 total rebate ($50 additional)
- 300 items sold — $175 total rebate ($75 additional)
- 400 items sold — $250 total rebate ($75 additional)
- 500+ items sold — $325 total rebate ($75 additional)
Invoicing. That's My Pan! issues an invoice upon order submission. Payment is due on the terms specified on that invoice (typically due on receipt). Accepted payment methods include check, credit card, and ACH transfer.
6. Product Warranty & 100% Satisfaction Guarantee
That's My Pan! stands behind every product with a 100% satisfaction guarantee. If a product is damaged, defective, or does not meet specification when received, we will replace the item at no cost to you.
Errors & corrections. If That's My Pan! makes an error — incorrect personalization or engraving — we remake the item at no charge. If you provide incorrect information for personalization, we will remake the item at a 20% discount. All warranty claims must be reported within 30 days of receiving your order.
7. Shipping & Delivery
Carrier. Orders ship via FedEx and USPS, depending on destination and package specifications.
Timeline. Orders typically arrive within 1–5 business days after shipment. Expedited shipping is not available through the fundraiser program.
Bulk shipping address. All bulk orders ship to a single address specified by the fundraiser organizer, who is responsible for distributing products to donors.
Exceptions:
- Alaska & Hawaii — charged actual USPS shipping cost rather than the standard $4.75 rate
- International — That's My Pan! does not currently ship outside the United States
8. Personalization & Customization
Included at no extra charge. Basic engraving and personalization — names, initials, dates, and custom text within each product's character limit — are included in the price shown.
Photo & Designer Series lids. Custom photo personalization requires a high-resolution image; you are responsible for providing a file that will look good enlarged onto the lid. For custom designs you will be asked to approve a digital proof before manufacturing begins — changes requested after approval may add delay or cost.
9. Intellectual Property & Brand Use
All That's My Pan! logos, trademarks, designs, product photography, artwork, and brand materials are owned by Adept Engraving LLC. You may not use these materials beyond what is provided on your fundraiser website without our written permission. You retain ownership of any text, photo, or information you submit for personalization; by submitting it, you grant us the right to use it solely to manufacture and deliver your order.
10. Limitation of Liability
This website and its services are provided on an "as-is" basis. That's My Pan! does not warrant uninterrupted, error-free, or virus-free operation. To the extent permitted by law, That's My Pan! is not liable for indirect, incidental, special, or consequential damages arising from your use of this website or our services; your sole remedy for a dispute is limited to the value of the products in question.
11. Disclaimer of Warranties
That's My Pan! disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we make reasonable efforts to keep product descriptions, pricing, and availability accurate, we do not warrant they are error-free.
12. Data, Privacy & Confidentiality
Your use of this website and our services is governed by our Privacy Policy. By registering, you consent to the collection and use of your data as described there. You are responsible for keeping confidential any customer or donor information you collect in the course of running your fundraiser.
13. Prohibited Conduct
You agree not to use this website for any illegal, fraudulent, or deceptive purpose; to impersonate another person or organization; to attempt to disrupt or gain unauthorized access to our systems; to spam, harass, or defame anyone through the website; to resell or redistribute That's My Pan! products outside your approved fundraiser; or to scrape data, prices, or images from the site for unauthorized use.
14. Indemnification
You agree to indemnify and hold harmless That's My Pan!, Adept Engraving LLC, and their officers, directors, and employees from any claim, damage, or expense (including reasonable legal fees) arising from your violation of these terms, your violation of applicable law, your infringement of a third party's rights, your conduct as a fundraiser, or a dispute with your own donors or customers.
15. Termination of Access
That's My Pan! may terminate your access to the website and fundraiser platform at any time, for any reason, with or without notice — including for violation of these terms, non-payment, fraudulent activity, or excessive chargebacks. On termination you must stop using the website; That's My Pan! is not liable for any consequence of that termination.
16. Copyright & Intellectual Property Infringement
If you believe That's My Pan! has infringed your copyright or other intellectual property rights, contact us at the address below. If we believe your submitted content infringes our rights, we will provide notice and an opportunity to respond.
17. Governing Law & Jurisdiction
These Terms of Service are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Chippewa County, Wisconsin, for any dispute arising from these terms or your use of this website.
18. Severability
If a court finds any provision of these terms invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will stay in full force.
19. Entire Agreement
These Terms of Service, together with our Privacy Policy and any policy referenced here, are the entire agreement between you and That's My Pan! regarding your use of this website and the fundraiser program, and supersede any prior agreement on that subject.
